Where to send what
- Unsafe food or a public-health risk: support@africandiscountfoods.com, subject “FOOD SAFETY”. We treat these as urgent.
- Illegal content, prohibited items, scams, fake reviews, harassment, policy breaches: legal@africandiscountfoods.com, subject “REPORT”.
- Copyright, trademark or other IP infringement: legal@africandiscountfoods.com, subject “IP NOTICE”, using the format in section 3.
- Privacy, data-protection or security issues: privacy@africandiscountfoods.com.
- Courts, regulators and law enforcement: legal@africandiscountfoods.com (section 6).
1. Reporting content or a user
Anyone may report content or conduct on AfricanDiscountFoods that they believe is illegal or breaks our Acceptable Use & Community Guidelines, Seller Agreement or Terms of Use. To help us act quickly, include:
- The exact location: the page URL, store name, product name, order number or the text of the review or recipe;
- What is wrong and, if you can, why you believe it is illegal (the law and country) or which rule it breaks;
- Any evidence: screenshots, photos, dates;
- Your name and email so we can follow up (you may report anonymously, but we cannot then tell you the outcome; reports of child sexual abuse material or terrorist content may be made anonymously and are always acted upon);
- A statement that you believe in good faith that the information in your report is accurate and complete.
We acknowledge reports promptly, review them without undue delay in the order received and by urgency, and tell you our decision and how to contest it. Reports from bodies designated as trusted flaggers under the EU Digital Services Act are prioritised. We may ask for more information and may share the substance of your report (not your contact details, unless the law requires) with the person whose content is affected. Deliberately false reports may lead to suspension of your reporting rights and, where the law provides, liability to the person affected.
2. What happens after a report
- We assess the content against the law of the relevant country and our policies, taking into account context and the rights of everyone involved, including freedom of expression.
- We may remove, hide, restrict or label the content, remove a badge, restrict or suspend an account, cancel orders, hold seller payouts, or take no action. Emergencies and manifestly illegal content are handled immediately.
- Where we act against content, the person who posted it receives a statement of reasons (what we did, why, which rule or law, whether automated tools were used, and how to appeal), except where the law prevents it.
- Both the reporter and the affected user may appeal within six months to legal@africandiscountfoods.com; appeals are reviewed by a person who was not involved in the original decision.
- We report serious criminal offences involving a threat to life or safety to law enforcement as the law requires, and we may share information about fraud and unsafe food with regulators, payment providers and other marketplaces.
3. Intellectual-property notices (copyright, trademark, design, database rights)
We respect intellectual-property rights and expect our users to do the same. If you are a rights-holder (or authorised to act for one) and believe content on AfricanDiscountFoods infringes your rights, send a notice to legal@africandiscountfoods.com containing the elements required by the US Digital Millennium Copyright Act (17 U.S.C. §512(c)(3)), the EU Digital Services Act (Article 16) and equivalent laws:
- Identification of the work or mark you say is infringed (for a trademark, the registration number and jurisdiction; for copyright, a description or link to the original);
- Identification of the infringing material and its exact URL or location on the site, sufficient for us to find it;
- Your name, address, telephone number and email, and, if you act for the rights-holder, evidence of your authority;
- A statement that you have a good-faith belief that the use is not authorised by the rights-holder, its agent or the law;
- A statement, under penalty of perjury where applicable, that the information in the notice is accurate and that you are the rights-holder or authorised to act on their behalf;
- Your physical or electronic signature.
On receipt of a complete notice we will remove or disable access to the material expeditiously, notify the user who posted it and give them a copy of the notice (minus your contact details where the law allows), and record the notice. Incomplete notices may be returned for completion. Submitting a knowingly false notice may make you liable for damages, including costs and legal fees (17 U.S.C. §512(f) and equivalents).
Counter-notice
If your content was removed because of an IP notice and you believe this was a mistake or misidentification, you may send a counter-notice to legal@africandiscountfoods.com containing: identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, telephone number and email; a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the United States, of the courts of [governing-law jurisdiction]) and that you will accept service of process from the person who sent the original notice; and your signature. We will forward the counter-notice to the original complainant and, unless they inform us within 10 to 14 business days that they have filed a court action, may restore the content.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers, and we keep records of notices for that purpose.
Designated agent
Notices under the DMCA may be sent to our designated agent: [Operator legal entity name], Attn: Legal / DMCA Agent, [Registered office address], email legal@africandiscountfoods.com. Registration with the US Copyright Office's DMCA Designated Agent Directory will be maintained by the operator.
4. Trademark, right-of-publicity and impersonation complaints
If a store name, listing or profile uses your registered trademark, business name, name or likeness without permission, or impersonates you, send the details in section 3 together with proof of your rights or identity. Descriptive and fair uses (for example naming a well-known brand of rice that a seller genuinely sells) are generally permitted.
5. Product-safety and recall notices
Producers, regulators and consumers can notify us of a recall, contamination or safety alert affecting products sold on the site. Email support@africandiscountfoods.com with “RECALL” in the subject, the product and lot details and the source of the alert. We will identify affected listings and orders, contact affected buyers and sellers, and remove listings while the issue is investigated. Sellers are contractually obliged to notify us within 24 hours of any recall affecting their goods.
6. Requests from courts, regulators and law enforcement
- Send legal process and information requests to legal@africandiscountfoods.com or by post to [Operator legal entity name], [Registered office address]. This address is also our single point of contact under Articles 11 and 12 of the EU Digital Services Act; communications may be in English or French.
- We disclose user data only in response to valid legal process (subpoena, court order, warrant, or a request that has a lawful basis in the requesting country and does not conflict with the law of the country where the data is held), or in an emergency involving imminent risk of death or serious injury. We review every request, disclose the minimum necessary, and, unless legally prohibited, notify the affected user.
- Requests from outside the operator's jurisdiction may need to proceed through mutual legal-assistance channels. Regulators exercising statutory powers (for example under the DSA, consumer-protection or food-safety law) should cite the power relied on.
- We publish, where required, periodic transparency information about notices received and actions taken.
7. Privacy and data-protection requests
Requests to access, correct, delete or port personal data, objections to processing, and complaints about a seller's handling of your data go to privacy@africandiscountfoods.com; the process and timelines are in the Privacy Policy. Security vulnerability reports also go there; we support good-faith research and coordinated disclosure.
8. Consumer complaints and disputes
Problems with an order are handled under the Refund Policy; start from your order page and escalate to support@africandiscountfoods.com. Formal complaints about our own conduct, and grievance-officer requests where local law provides for them (for example India's E-Commerce Rules), go to legal@africandiscountfoods.com; we acknowledge within 48 hours and aim to resolve within one month. Consumer authorities and alternative-dispute-resolution bodies may contact us at the same address.
